The post-conventions Carnival of Latin America and the Caribbean

The RNC and the DNC had their conventions in two consecutive weeks, and after their monopolizing media attention, we’re glad they are over.

Almost unnoticed, however, was the story of the Syrian terrorist released from Guantanamo to Uruguay, who supposedly needs crutches to get around, was missing for several weeks, to eventually turn up some 4,600 miles away from Montevideo (a little under the distance from New York to Moscow), in Venezuela, of all places, just so he can petition the Uruguayan consulate – which he could do in Montevideo – to “ask for assistance to fly to Turkey or some other country to be reunited with his family.” Which gave him plenty of time to do all sorts of things.

Nicaragua’s top electoral authority decimated the country’s political opposition on Friday by unseating practically all of its remaining lawmakers in congress as President Daniel Ortega prepares to seek a third term.

The Supreme Electoral Council ousted 16 opposition legislators from the Liberal Independent Party and its ally the Sandinista Renovation Movement Friday for not recognizing their officially sanctioned leader. That leader, Pedro Reyes, had recently been given that authority by the Supreme Court, which removed the opposition party’s previous leader following a long-running political dispute. Reyes is seen by some within his own party as a tool of Ortega.

Ecuador: SCOTUS denies appeal

U.S. Supreme Court Backs Chevron in Treaty Dispute with Ecuador

The United States Supreme Court declined to hear an appeal lodged by the government of Ecuador that contested a $96 million arbitration settlement awarded to the American oil company Chevron.

Texaco, the company Chevron bought out in 2001, originally filed the suit against the Central American country for breaking from the terms of oilfield development contracts and international agreements.

In effect, the highest court in the U.S. upheld a ruling by the U.S. Court of Appeals for the District of Columbia Circuit, which favored Chevron in an arbitration deal issued by The Hague’s Permanent Council of Arbitration in the Netherlands.

The arbitration process started in The Hague in 2006 with Texaco claiming that Ecuador’s court system failed to resolve disputes in a timely manner, as the nation had agreed to in a 1997 investment treaty with the U.¬S. government.

The panel awarded the multimillion-dollar settlement to Chevron, which prompted it to file a federal suit with the U.S. government in order to collect the amount of the award. The year 2013 saw the approval of the deal under the gavel of a federal judge, but Ecuador lodged an appeal soon after, arguing that the arbitration tribunal did not have jurisdiction over the case since Texaco had ceased operations in Ecuadorian oilfields in 1992—five years before the treaty at play.

The amount of the award now stands at $106 million after the calculation of interest, according to company spokesperson Morgan Crinklaw, who also said the oil and gas major was “pleased” that Ecuador would be held accountable.

On the one hand, Ecuador was saying that in this case “the arbitration tribunal did not have jurisdiction over the case since Texaco had ceased operations in Ecuadorian oilfields”. On the other hand, in a different case Ecuador claims Chevron is liable for damages even when Chevron never conducted oil production operations in the country.

Some warn that Puerto Rico could be a test case for the rest of the country, paving the way for troubled states like Illinois to escape unsustainable debts.

Stephen J. Spencer, a restructuring expert representing Puerto Rico bondholders including some hedge funds, said letting the government renege on agreements with hedge funds and other investors would set a dangerous precedent, undermining the integrity of the bond market.

“It’s really a wealth transfer from the bondholders to the municipalities,” Mr. Spencer said.

The bondholders include large numbers of retirees.

Today’s Capt. Louis Renault moment brought to you courtesy of Maduro’s nephews

As you already know, Efraín Campos Flores and Francisco Flores de Freitas are in real trouble, after being indicted on drug trafficking conspiracy charges, and held without bail.

They have now hired attorneys Rebekah J. Poston and John Reilly, both partners at Squire Patton Boggs LLP.

Why is this a Capt. Louis Renault moment?

Last year Venezuela’s government-owned PDVSA’s subsidiary CITGO paid Squire Patton Boggs over $1.7 million for lobbying to Congress on its behalf.

“I am shocked, shocked!” that the Floreses would hire them.

I’d actually be shocked if the money did not come from PDVSA in some form or another.

[If the law firm’s name sounds familiar, Patton Boggs was involved in the Chevron/Ecuador case prior to its merger with Squires Sanders.]
